Elsevier print terms and conditions
This agreement (“Agreement”) sets forth the terms and conditions governing the use of Elsevier print books ("Print Books") and is made by and between the Elsevier group affiliate (“Elsevier”) that sells the Print Books and the individual consumer (“you”). By using Print Books, you agree to be bound by these Terms. If you do not agree, you must not purchase and use Print Books from Elsevier.
This Agreement expressly incorporates by reference and includes Elsevier’s Terms and Conditions of Purchase (https://www.elsevier.com/legal/elsevier-website-terms-and-conditions/elsevier-terms-and-conditions-of-purchase), the Elsevier Website Terms and Conditions (https://elsevier.com/legal/elsevier-website-terms-and-conditions), Elsevier’s Privacy Policy (https://elsevier.com/legal/privacy-policy), and any guidelines, rules or disclaimers that may be posted and updated on specific web pages of the Elsevier-merchant website where the Print Book was purchased, printed in the Print Books themselves, or on notices that are sent to purchasers and/or users of Elsevier Print Books. By checking the box "I have read and understand the Terms and Conditions of use and agree to be bound by all of its terms" on the registration page and/or the Elsevier-merchant website where you purchased the Print Book, and/or by using the Print Books, you agree to be bound by all the terms and conditions of this Agreement. Please carefully review this Agreement before ticking the relevant check box or using the Print Books.
1. AUTHORIZED USES
Print Books may be used for your own personal, scholarly, informational, or non-commercial purposes.
2. RESTRICTED USES
Except as may be expressly permitted in this Agreement, to the extent such restrictions are not prohibited by law, you may not:
copy, reproduce, modify, transmit, display, or create derivative works from any content in Print Books without prior written permission from Elsevier;
sell, rent, license, or otherwise distribute any part of the Print Books;
remove or obscure any copyright notices or proprietary legends contained in Print Books;
convert Print Books into electronic format without authorization from Elsevier;
use Print Books in combination with an artificial intelligence tool (including to train an algorithm, test, process, analyse, generate output and/or develop any form of artificial intelligence tool);
use Print Books in any way that infringes Elsevier’s rights, the rights of others, or violates applicable law.
3. INTELLECTUAL PROPERTY RIGHTS
All content contained in Print Books is protected by copyright, trademark, and other intellectual property laws. You acknowledge that all right, title and interest in and to the Print Books remains with Elsevier and its suppliers, except as expressly set forth in this Agreement, and that the unauthorized redistribution or dissemination of the Print Books could materially and irreparably harm Elsevier and its suppliers.
4. ELSEVIER WARRANTIES AND LIMITATION OF LIABILITY
4.1 Warranties
Elsevier warrants that the use of Print Books in accordance with the terms and conditions herein will not infringe the intellectual property rights of any third party.
4.2 Disclaimer
EXCEPT FOR THE EXPRESS WARRANTIES STATED HEREIN AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, ELSEVIER AND ITS SUPPLIERS PROVIDE THE PRINT BOOKS “AS IS” AND MAKE NO REPRESENTATION OR WARRANTY AND EXPRESSLY DISCLAIM ANY LIABILITY FOR ANY CLAIM ARISING FROM OR OUT OF THE PRINT BOOKS, INCLUDING BUT NOT LIMITED TO ANY ERRORS, INACCURACIES, OMISSIONS, OR DEFECTS CONTAINED THEREIN, AND ANY IMPLIED OR EXPRESS WARRANTY AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
4.3 Limitation of Liability
To the maximum extent permitted by law, Elsevier and its Suppliers shall not be liable for any indirect, incidental, or consequential damages arising from your use of Print Books. Elsevier and its Supplier’s total liability shall not exceed the amount paid for the Print Book.
5. GENERAL
5.1 Force Majeure
Neither party’s delay or failure to perform any provision of this Agreement as a result of circumstances beyond its control (including, but not limited to, war, strikes, fires, floods, governmental restrictions, power failures, telecommunications or Internet failures or damage to or destruction of any network facilities or servers) that prevents it from fulfilling its obligations under this Agreement (any such circumstances being “Force Majeure”) shall be deemed a breach of this Agreement.
5.2 Severability
The invalidity or unenforceability of any provision of this Agreement shall not affect any other provisions of this Agreement.
5.3 Changes
Elsevier reserves the right to update, revise, supplement and otherwise modify this Agreement from time to time. Any such changes will be effective immediately and incorporated into this Agreement. You are encouraged to review the most current version of the Agreement on a periodic basis for changes. Your continued use of the Print Book following the posting of any changes constitutes your acceptance of those changes.
5.4 Entire agreement
This Agreement contains the entire understanding and agreement of the parties and merges and supersedes any and all prior and contemporaneous agreements, communications, proposals and purchase orders, written or oral, between the parties with respect to the subject matter contained herein.
