Elsevier product specific terms and conditions
These Elsevier Product Specific Terms and Conditions form an integral part of all contracts relating to Subscribed Products between a subscribing organization (“you” or “your”) and Elsevier B.V., or its affiliated companies (“we” or “us”), as reflected in an executed online Order Form. The Elsevier General Terms and Conditions of Sale, the relevant Product Specific Terms and Conditions and the Order Form, including if appliable a SOW, are jointly referred to below as “Agreement”.
ELSEVIER PRODUCT SPECIFIC TERMS AND CONDITIONS FOR PURE
The Fees are based upon the number of persons with profiles in the Subscribed Products except that no fee will be charged for use of Subscribed Products to profile student work, student teachers, teaching aid staff, research assistants, or lab technicians. For the avoidance of doubt, no fee will be charged for administrative staff who use the Subscribed Products but are not profiled in the Subscribed Products.
Additional person profiles may be added to the Subscribed Products subject to appropriate Fee adjustments.
Additional Security Measures:
To the extent that we are processing personal data on your behalf in providing the Subscribed Products, the additional security measures set forth below will apply.
A. Details of Processing
The subject-matter and duration of the processing, the nature and purpose of the processing, the type of personal data, the categories of data subjects and your obligations and rights are set forth in the Agreement, in particular:
Description of the Subject-Matter of the Processing
The subject-matter of the processing is the personal data provided by you in respect of the Subscribed Products and any services as part of a SOW under the Agreement.
Duration of the Processing
The duration of the processing is the duration of the provision of the Subscribed Products and any services as part of a SOW under the Agreement.
Nature and Purpose of the Processing
The nature and purpose of the processing is in connection with the provision of the Subscribed Products and any services as part of a SOW under the Agreement.
Categories of Data Subjects
The categories of data subjects are the Authorized Users and may include researchers, professors, visiting professors, honorary professor, (university) teachers, post-doc’s, PhD-students, master students, persons with research relation, visiting fellows, co-author of publications and other individuals about whom personal data is submitted to us by or at your direction as part of the Subscribed Products and any services as part of a SOW under the Agreement.
Categories of Personal Data
The types of personal data processed may include the following categories of personal data submitted to us by you or at your direction as part of the Subscribed Products and any services under a SOW, or any other personal data which you input in the Subscribed Products through free text fields or by any other means, under the Agreement: Unique personnel number, First birth name, First name (if different from First birth name), Initials (birth names), Initials (if different from birth names), Last Name (last birth name, last name partner, combination), Prefix, Date of birth, Sex (M, F or unknown), Nationality, Starting date employment contract, End date employment contract, Full time or part time employment (in fte), Full time or part time for research per employee (in fte), Starting date research, End date research, Affiliation / honorary professor, Starting date Job profile/position, End date Job profile/position, Work relations, Job profile, University job classification, Alternative function(s) employee, Title, E-mail address, Photo.
B. Technical and Organizational Measures
Information Security Program
The Subscribed Products are ISO/IEC 27001:2013 Certified.
We shall implement, document, and as appropriate, review, test and update policies and procedures that contain administrative, physical and technical safeguards relevant to the access, use, loss, alteration, disclosure, storage, destruction and control of information and which are measured against objective standards and controls (our “Information Security Program”). Our Information Security Program shall include the implementation of appropriate technical and organisational measures to ensure a level of security appropriate to the risk related to processing of personal data provided to us under the Agreement.
Our Information Security Program shall take account in particular of the risks that are presented by processing, in particular from accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to personal data transmitted, stored or otherwise processed;
Human resource aspects
The background of all candidates for employment is verified in accordance with relevant legislation and regulations and the verification is proportionate to the risk category of the personal data to which those candidates will have access.
We require all employees and contractors to comply with information security and privacy practices in accordance with our Information Security Program.
We have procedures in place to ensure that the access rights of users are (timely) withdrawn at the end of the contract or employment.
Logical security
Only the employees who need it for their work have access to the personal data and those employees have the minimal access rights that are required for the performance of those activities.
We have taken steps to protect our information systems against unauthorized access via the network (internet).
We have taken measures to prevent the company network or systems from being infected with malware.
Where we transport personal data outside the company's own network, measures have been taken to protect that data against unauthorized access.
We have taken measures to ensure that unauthorized access to personal data in our corporate network is continually monitored (as deemed appropriate) so that you can be informed promptly if such unauthorized access that impacts your data has occurred.
Access rights of employees are periodically checked for correctness.
Data is encrypted during transfer and at rest. The encryption key is controlled by us.
Physical security
Data carriers containing personal data are protected during use and transport against unauthorized access, misuse or loss of integrity. In this context data carriers refers to media such as: paper, USB sticks, CD-ROMs, computers (in particular laptops), tablets, smartphones. If the personal data is no longer needed, it is cleaned up in a safe way according to formal procedures.
We have taken physical measures to protect our information systems against unauthorized access. The number of employees with access to the server room is limited and in accordance with job level and responsibilities.
Operations management
We have a written and formally established change management process, ensuring that only authorized and tested changes are introduced into the live environment.
Third Party Security
We shall require that any third party has in place substantially similar security safeguards and controls as those set forth herein, and shall monitor our third parties as appropriate and as may be required by applicable law.
ELSEVIER PRODUCT SPECIFIC TERMS AND CONDITIONS FOR INTERFOLIO
The Fees are based on your current Full time Employee (“FTE”) base as of date of the Order Form. This Agreement provides for access for the Authorized Users as identified in this Agreement, which may be limited to your indicated department or school only. Additional Authorized Users may be added subject to appropriate Fees adjustments. Remote campuses, specialty schools (such as medical, law, graduate schools, etc.), international campuses, and continuing education units are not included in this license, unless explicitly scoped into the FTE agreement, and may require additional fees for access.
Additional Authorized Uses
In addition to the Authorized Uses as set out in section 1.2 of the Elsevier General Terms and Conditions of Sale the following will be added for Interfolio Subscribed Products:
You may:
view, download, reproduce, and print Dossier User Content (as defined below) made available to you by a Dossier User (as defined below), with their prior consent, through the Subscribed Products solely for your internal purposes.
"Dossier Users” are individuals (e.g. applicants) who have access to the dossier of the Subscribed Products, either as Authorized Users or otherwise through a Dossier account.
“Dossier User Content” means any content and information about Dossier Users, including, but not limited to, resumes, CVs, academic achievements, writing samples, transcripts, cover letters and letters of recommendations. As between us and you, the parties acknowledge and agree that the Dossier User is entitled to provide the Dossier User Content.
You grant us the right to grant each Dossier User a non-exclusive, worldwide, royalty-free and fully paid license to: (a) extract data that is related to that Dossier User to create Dossier User Content (e.g., extract biographical data for a grant proposal or consultant work) to the extent that functionality is enabled by you; and (b) share that Dossier User’s Dossier User Content with us and third parties to the extent that functionality is enabled by you. You control the extent a Dossier User can use your content to create public profiles. This right is limited to the information and your content, you have authorized for public sharing. All rights in and to your content not expressly granted to us in this Agreement are reserved by you.
Customer Advisory Service
The Customer Advisory Service includes Customer Support for your users, applicants, and candidates via the Scholar Services team.
One-Off Implementation Services
Implementation Services include a designated Project Manager during implementation. Services related to implementation shall be used within one year from the start date of the Agreement. In the event such implementation services are not used within the first year of the Term, you acknowledge and understand additional fees may be charged to complete the scope of implementation.
ELSEVIER PRODUCT SPECIFIC TERMS AND CONDITIONS FOR RESEARCHFISH
Upon one-year anniversary of the commencement of this Agreement, and every twelve (12) months thereafter, in the event that the amount of funding tracked in the Researchfish platform (for Researchfish Explorer), or research intensity (for Researchfish or Administrator) increases or decreases by 15%, the pricing will be reviewed, and the parties will agree on appropriate adjustments of the Fees.
ELSEVIER PRODUCT SPECIFIC TERMS AND CONDITIONS FOR SCIBITE
The subscription is valid for one production instance of the software to be used within your environment.
A production instance is defined as an installation of the Subscribed Product (on-premise or on your cloud service or hosted) for use by the authorized department/group or within the application named in the Order Form, to perform your research activities. For operation purposes we authorize an additional instance for test and development purpose only, to be used by the authorized department/group or to support the application named in the Order Form. Unlike the production instance, the test and development instance cannot be used to support research activities or run real life queries.
A subscription for a development instance will be granted for testing purposes only.
No third-party licenses are included or implied under this Agreement. In the event that our VOCab/Ontology requires a license (e.g. MedDRA, SNOMED), it is your responsibility to ensure that the appropriate license is in place. For SNOMED derived VOCabs, it is your responsibility to ensure that they are either in a member country or have a valid license agreement, details of which are at https://www.snomed.org/snomed-ct/get-snomed opens in new tab/window.
Integration of Subscribed Products.
You may integrate the Subscribed Products with other software and platforms, provided that before doing so:
you notify us of the proposed integration and provide such further details and information as we may reasonably request; and
you comply with any of our requests that the proprietor of any third party software or platform should enter into appropriate confidentiality and security undertakings with us, relating to the Subscribed Products and the documentation; and
that any copies of the Subscribed Products required by any third parties for such integration are provided by us and not distributed by you; and
you maintain up to date records and technical specification of the integration to meet the requirements set out herein.
Additional Restrictions of Use of Subscribed Products.
In addition to the restrictions as set out in section 1.3 of the Elsevier General Terms and Conditions of Sale, the following will be added for the SciBite Vocabularies (VOCabs) Subscribed Product:
reverse-engineering includes any attempt to re-create non-compiled versions or sub-sets of the SciBite Vocabularies Subscribed Product through any means. Applications which store data from the SciBite Vocabularies Subscribed Product, including identified synonyms, must only use that data within that application and may not export it to other applications.

Support Days
All support days included in this Agreement need to be scheduled and assigned to an activity a minimum of 3 months before the end of the Term.
SciBite Chat
SciBite Chat responses are AI-generated without human review and are intended to support information discovery as part of the Subscribed Product SciBite Search. You and your Authorized Users must exercise your own judgment before acting on or applying any responses. Content is in English and while browser translated inputs and responses may be supported, translations have not been validated.
You are responsible for monitoring your use of Chat GPT Tokens. If you have used up your Chat GPT Tokens, you will need to purchase additional Chat GPT Tokens to continue to use the SciBite Chat features. "Chat GPT Tokens" refer to the units allocated to you for the purpose of processing queries within the SciBite Chat feature. The starter tier includes 500,000 Chat GPT Tokens. Once these Chat GPT Tokens are exhausted, additional tokens must be purchased to continue using the SciBite Chat features.
SciBite Search
Access to undocumented web service end points/APIs within the SciBite Search system are prohibited and deemed in breach of this Agreement and may cause data corruption. This includes access to any internal sub-components that include, but are not limited to, Named Entity Recognition, Relationship Extraction and other text-analytics services.
WorkBench
The Agreement provides access to WorkBench to support the enrichment of tabular or semi-structured data via the User Interface (UI) or Application Programming Interface (API). WorkBench provides an interface to support tabular and semi-structured data harmonization using TERMite. While WorkBench can be used without limitation to support the tabular and semi-structured data harmonization use case, an underlying TERMite license is required for each use case served via WorkBench.
Ontology Entity Registry App
The Ontology Entity Registry App facilitates the copying of ontologies from CENtree to the Benchling platform. As Benchling is a third-party platform, we cannot be held liable for any issues or interruptions that may arise from their platform. You will be responsible for managing updates and synchronization between CENtree and Benchling.
